Terms of use

These terms are an agreement between you and Above AVG Inc. (“Above AVG”, “we”), which operates the totalMOS platform under license. They govern the use of totalMOS, the manufacturing operating system made up of the web app, the iPad app and this website, by the organisation that subscribes to the service (the “plant”) and by every person the plant invites to use it. Where the plant has signed an order form or a service agreement with us, that agreement prevails over these terms.

1. The service

totalMOS schedules production, weighs out batches against a formula, runs checklists, records quality checks against each product’s specification, and tracks non-conformities, holds and corrective actions. If the plant’s administrators turn it on, Mozzie, the AI assistant, answers questions about the plant’s records with summaries, charts, tables and PDF or Excel exports; it only reads, and cannot create, change, submit or delete anything. It stays off until an administrator turns it on. We may improve or change features over time; we will not remove a feature the plant relies on without reasonable notice.

2. Accounts and access

Access is by invitation only. The plant’s administrators decide who is invited and which role each person has, and are responsible for removing access when someone leaves. Each person signs in with their own email address and a one-time code and must not share their access or let someone else use their session. Tell your administrator or us immediately if you think an account has been misused.

3. Acceptable use

Use totalMOS only for the plant’s legitimate operations. Do not try to access another organisation’s data, probe or disrupt the service, get around its security or role controls, upload malicious content, or record false or misleading information. Ask Mozzie only about the plant’s records, do not try to make it go beyond its limits, and put no more personal information in a question than the question needs.

4. The plant’s data

The plant owns the data it records in totalMOS: products, specifications, readings, photos, non-conformities, batch records and everything else it enters. We use that data only to provide the service, as described in our privacy policy, and we never sell it. The plant can export its records at any time, and on request when the subscription ends. We delete the plant’s data within 90 days after the end of the subscription, unless the law requires us to keep it longer. When Mozzie is on, the records it reads to answer a question are sent to its AI provider for that purpose only, and are not used to train AI models.

5. Personal information

We handle personal information as described in the privacy policy and in accordance with Québec’s Act respecting the protection of personal information in the private sector. For the people who use the app at a plant, the plant is the organisation responsible for that information and we act as its service provider.

6. Confidentiality and security

Each party keeps the other’s confidential information confidential. We protect the service with encryption in transit, access limited by role, private storage of files and an audit trail, and we tell the plant without delay about any confidentiality incident that affects its data.

7. Availability and support

We aim to keep totalMOS available at all times, apart from planned maintenance announced in advance, but we do not guarantee uninterrupted service. Support is provided by email on business days.

8. Fees

Fees, billing periods and payment terms are set in the plant’s order form or service agreement. Mozzie comes with a monthly usage allowance; when the plant reaches it, the assistant pauses until the first day of the next month.

9. Intellectual property

We own totalMOS, its software and its content. The plant receives a non-exclusive, non-transferable right to use it for the length of its subscription. Feedback you send us may be used to improve the service.

10. The plant’s responsibilities

totalMOS helps the plant keep accurate records; it does not replace the plant’s own quality system, food-safety program or regulatory obligations. The plant remains responsible for its specifications, its decisions on product and the accuracy of what it records. Answers from Mozzie, the AI assistant, are written by an AI model from the plant’s records and can be wrong: check them against the records they link to before acting on them.

11. Warranties and liability

The service is provided “as is”, to the extent the law allows. Neither party is liable for indirect or consequential damages, and our total liability is limited to the fees the plant paid for the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

12. Suspension and termination

We may suspend access that breaches these terms or threatens the security of the service. Either party may end the subscription as set out in the plant’s agreement; sections 4, 6, 9 and 11 survive.

13. Changes to these terms

When these terms change, we update the date above and notify the plant’s administrators before the change takes effect. Continuing to use the service afterwards means accepting the new terms.

14. Governing law and language

These terms are governed by the laws of Québec and the federal laws of Canada that apply there, and disputes fall under the courts of the judicial district of Montréal. They are published in French and in English; the French version prevails if the two differ.
